How can we unlock a family member's iphone 4S , this family member has died?

my uncle died in October of this year we have his iphone 4S we do not know or have his apple ID nor do we know or have his pass word to this phone he did buy the iphone 5S some times in the negining of the year and we think he wasn t using the iphne 3S any longer is there any way that you can help us in getting the iphone 4S unlocked so it can be used Thanks for your help Keith

The iCloud Activation Lock keeping you out is a consequence of anti-theft measures to prevent thieves from using stolen iPhones. There are lots of scams online that promise to remove it, but beware. As far as I know, there is no easy solution for you. The only way you might be able to gain access is to take proof of ownership, perhaps the bill of sale for his cell phone bill along with his death certificate and something showing you are entitled to it (like a will) to an Apple Store.
